Teen Killed in Single-Vehicle Starke Crash

By Florida Auto Accident Attorney on July 26, 2010

A teenage girl was killed Friday night, July 23, in the small town of Starke, Florida, an article in the Florida Times-Union reported.

The crash occurred when the driver of a Ford 150 pickup truck lost control of the vehicle. As it started heading toward the woods, the truck overturned, ejecting two passengers in the vehicle and killing one. The Florida Highway Patrol says it is unclear who was driving the 2002 pickup.

The victim who died was Haley F. Forsyth, 17. Amber Sweat, 17, and John Howard, 18, were injured, Amber seriously. All three teens are from Starke and were taken to Shands Hospital in Starke. The accident happened around midnight on SW 163rd Street near SW 155 Way, west of Starke.

Our sincere condolences go out to the friends and family of Forsyth who lost her young life in this tragic accident. We will pray for the recovery of Amber. Howard was very lucky to receive only minor injuries.

(Newser) – Florida revoked Megan Mariah Barnes' driver's license last week, and less than a day later she proved the wisdom of that decision, causing a car accident on US Highway 1 in the Florida Keys as she shaved her private parts while driving. " About 10 years ago I stopped a guy in the exact same spot who had three or four syringes sticking out of his arm," the highway patrol officer who busted her tells KeysNews.com. "It was just surreal and I thought, 'Nothing will ever beat this.' Well, this takes it. "

Seat Belt Statistics
Unfortunately no one in this pickup truck was wearing their seat belt, according to FHP.

The same scenario struck the hearts of more than 4,054 parents of teens, ages 13 to 19, nationwide who were killed in motor vehicle crashes in 2008, according to the Insurance Institute for Highway Safety.

According to the Florida Department of Highway Safety and Motor Vehicles, 2,983 people were killed in motor vehicle related crashes in 2008. Of these deaths, 1,795 individuals were drivers or passengers in vehicles equipped with safety belts and 60 percent (1,085) of them were not wearing safety belts.

In addition, 68 percent (54 of 79) of children up to age 17 involved in traffic crashes were not using safety equipment.

Teen Crashes
Unfortunately, the immaturity among young adult drivers often leads to risky driving practices. That is why auto accidents are the leading cause of death among teens. Florida wrongful death car accidents involving teens are often single-vehicle crashes resulting from not just a driving error, but speeding. And unfortunately, there often are other young people in the vehicle.

Florida Car Crash Accident Lawyers, Florida Injury Lawyers

If you have been in an auto accident in Florida and need a lawyer  be cautious in your choice. Florida is full of Auto Accident PIP clinics that are after your insurance money. They may not have the best lawyers affilliated with them. Injury Lawyer Network has a track record of experiemced lawyers helping accident victims since 1991.

Each year, thousands of people are involved in traffic accidents during the year in Florida. If you are one of these unfortunate people, will you know what to do in the aftermath of a collision? How you react can prevent further injuries, reduce costs and accelerate the clean-up and repair process. Will you know how to chose the best lawyer? How does one pick with so much advertising going on.

First if you are involved in a traffic collision, try to remain calm, and follow these steps:

Action Plan to Deal with Accidents:

1. Keep an Emergency Kit in Your Glove Compartment. Drivers should carry a cell phone, as well as pen and paper for taking notes, a disposable camera to take photos of the vehicles at the scene, and a card with information about medical allergies or conditions that may require special attention if there are serious injuries. Also, keep a list of contact numbers for law enforcement agencies handy. Drivers can keep this free fill-in-the-blanks accident information form in their glove compartment. The DocuDent™ Auto Accident Kit ($19.95), supported by AAA and insurance companies, offers a comprehensive kit that includes a flashlight, reusable camera and accident documentation instructions. A set of cones, warning triangles or emergency flares should be kept in the trunk.

2. Keep Safety First. Drivers involved in minor accidents with no serious injuries should move cars to the side of the road and out of the way of oncoming traffic. Leaving cars parked in the middle of the road or busy intersection can result in additional accidents and injuries. If a car cannot be moved, drivers and passengers should remain in the cars with seatbelts fastened for everyone's safety until help arrives. Make sure to turn on hazard lights and set out cones, flares or warning triangles if possible.

3. Exchange Information. After the accident, exchange the following information: name, address, phone number, insurance company, policy number, driver license number and license plate number for the driver and the owner of each vehicle. If the driver's name is different from the name of the insured, establish what the relationship is and take down the name and address for each individual. Also make a written description of each car, including year, make, model and color — and the exact location of the collision and how it happened. Finally, be polite but don't tell the other drivers or the police that the accident was your fault, even if you think it was.

4. Photograph and Document the Accident. Use your camera to document the damage to all the vehicles. Keep in mind that you want your photos to show the overall context of the accident so that you can make your case to a claims adjuster. If there were witnesses, try to get their contact information; they may be able to help you if the other drivers dispute your version of what happened.

5. File An Accident Report. Although law enforcement officers in many locations may not respond to accidents unless there are injuries, drivers should file a state vehicle accident report, which is available at police stations and often on the Department of Motor Vehicles Web site as a downloadable file. A police report often helps insurance companies speed up the claims process.

6. Know What Your Insurance Covers. The whole insurance process will be easier following your accident if you know the details of your coverage. For example, don't wait until after an accident to find out that your policy doesn't automatically cover costs for towing or a replacement rental car. Generally, for only a dollar or two extra each month, you can add coverage for rental car reimbursement, which provides a rental car for little or no money while your car is in the repair shop or if it is stolen. Check your policy for specifics.

The final question in dealing with an accident is usually who will pay for the damages? If the accident was minor, you and the other drivers may decide to handle the damages yourselves without the involvement of an insurance company. But this isn't always the best idea, for several reasons.

While the other driver may agree to pay for the damage to your car on the day of the accident, he may see the repair bills and decide it's too high. At this point, time has passed and your insurance company will have more difficulty piecing together the evidence if you file a claim.

Also, keep in mind that you have no way of knowing whether another driver will change his mind and report the accident to his insurance company. He may even claim injuries that weren't apparent at the scene of the accident. This means that your insurance company may end up paying him a hefty settlement, or worse yet, you could be dragged into a lawsuit. So make sure that your company has your version of what happened and check your policy — if the damages paid out by your insurance company are below a certain amount, the accident may not be considered chargeable. And you will avoid the penalty of a premium hike.

Airplane Accidents and Injuries

Aviation Law

Many federal, state, and international laws exist to regulate standards for the maintenance, operation, and safety of airplanes. However, even though these laws help protect passengers of airlines, an accident may still happen. Aviation law covers personal injuries that occur aboard aircraft, including slip and fall accidents and wrongful deaths that may occur in the rare case that an airplane crashes.

The laws that govern air travel are highly specialized, and the causes of airplane accidents may be difficult to determine. If you or a loved one has been injured in an airplane accident, our lawyers can review your case.

Airplane Accidents and Injuries

Pilots and other airline employees are required to meet certain standards to ensure the safety of their passengers. When they fail to meet these standards, accidents can occur. Both airplane crashes and accidents within the aircraft can be caused by the negligence of airline employees and faulty equipment.

Airplane crashes and injuries can be caused by

  • Dangerous conditions inside the aircraft
  • Careless handling of the aircraft
  • Severe turbulence
  • Negligent actions by incompetent flight staff
  • Faulty maintenance of the aircraft and equipment
  • Poor flight and airport traffic control
  • faulty equipment at the airport

Airplane crashes are rare, but when they do occur they often cause catastrophic injuries to passengers, and in some cases wrongful death. If you have lost a loved one in an airplane accident or crash that was caused by the negligent actions of the airline or an airline employee , our attorneys can assist you in filing a wrongful death lawsuit and protect your rights. Those who are responsible must be held accountable.

Because of the potential accidents that can occur while aboard an aircraft, airlines carry insurance to cover passenger injuries. If you have been injured in an airplane accident, our Attorneys can help you get the compensation you deserve.

Post Traumatic Stress After an Auto Accident, Auto Accident lawyers

Written by Auto Accident. Posted in Accidents Injuries Wrongful Death

Post-traumatic Stress Disorder , Post-traumatic Stress After a Traffic Accident

Auto Accident Helpline of Injury Lawyer Network is monitored by a medical social worker with experience with people in crisis situations. "I found this Article very interesting and am posting it for both injured people and attorneys who may not be aware waht their clients are going thru emotionally and how this can affect theor ability to react in a deposition.

Each year more than 6 million traffic accidents occur in the United States. If you've been in an accident, you might have experienced many different feelings at the time of the accident and in the days following it. Some of these feelings might have included the following:

    Shock
    Trouble believing it really happened
    Anger
    Nervousness or worry
    Fear or uneasiness
    Guilt

In addition, you might keep going over the accident in your mind. You might feel like you can't stop thinking about it.

Most people who have been in an accident have some (or all) of these feelings. Sometimes, though, these feelings can be so strong that they keep you from living a normal life after the accident.
What's the difference between normal feelings after an accident and feelings that are too strong?

For most people who are in a traffic accident, overwhelming feelings about it go away over time. However, sometimes, those feelings don't go away or they become stronger, changing the way you think and act. Strong feelings that stay with a person for a long time and start to get in the way of everyday life are signs of a condition called post-traumatic stress. If you have post-traumatic stress, you may have some of the following problems:

An ongoing, general feeling of uneasiness
Problems driving or riding in vehicles
Not wanting to have medical tests or procedures done
Irritability, or excessive worry or anger
    Nightmares or trouble sleeping
A feeling that you're not connected to other events or people
Ongoing memories of the accident that you can't stop or control

How can I cope with the feelings I have after my accident?

Talk to friends, relatives or a counselor about the details of the accident and how you thought, felt and acted at the time of the accident and in the days after it.
Stay active. Exercise often and take part in activities (anything that doesn't bother any injuries you sustained during the accident). Your family doctor can help you figure out how much you can do safely.
Follow up with your family doctor. Your doctor can give you referrals to other health care providers if necessary, monitor your recovery and prescribe any medicine you may need.
Try to get back to your daily activities and routines. Traffic accidents make some people limit what they do. It's important to try to get back to your usual activities, even if you're uncomfortable or scared at first.
Learn to be a defensive driver. Driving or riding in cars might be hard after the accident. You can lower your risk of future accidents or injuries by driving carefully, wearing your seat belt at all times and avoiding distractions while you're driving. Avoid driving when you're tired. Never drive if you have had alcohol or taken drugs or medicines that affect your judgment.

When you go an a cruise you are expecting fun, relaxation and a well planned vacation. You have put your trust in the cruise ship company to protect you while on board. However, Cruise ship accidents and injuries do happen. If you or a Loved one is injured on a cruise ship that embarked for a Florida port you may have Florida venue for an individual or class action lawsuit. Common cruies ship injuroes include:

Slip and Fall Injuries may occur

Slip and fall injuries are incredibly common aboard cruise ships. Falls may not seem to be a cause of serious injury, but the extent of your injuries may not become clear until several days after the initial fall. Internal injuries or head injuries may not be apparently right away. The decks may become slippery and the movement of the ship can cause loss of balance.

It is the cruise ship's  obligation  to maintain safe conditions aboard the ship for it's passengers. If you’ve fallen on a cruise ship and sustained injuries due to someone else’s negligence, contact  one of our admiralty lawyers to  see if you have a claim. A Plaintiff slipped on a staircase aboard the REGAL
EMPRESS on the night of October 8, 1993 and fractured her left patella.
She was evacuated from the ship.

Food-related Illnesses and food poisoning
Cruise ships often feature elaborate dinners and buffets.Cruise ships serve thousands of passengers everyday, so there is a greater chance that the food-related illness will affect a large number of people. There can be bacteria that causes severe reactions. Unfortunately, on a confined cruise ship where everyone is eating the same thing, a bout of food poisoning can often effect a large number of passengers. In June 2000 there was an outbreak on the Disney Magic that caused over 260 people to develop gastroenteritis. The U.S. Centers for Disease Control and Prevention (CDC) is the government agency responsible for investigating outbreaks of diarrhea on cruise ships. The CDC traced the illness to shrimp that was served on the embarkation lunch buffet. The CDC found "a variety of bacterial and parasitic pathogens" in stool samples of passengers who ate the shrimp.

Fires
Fires aboard a cruise ship can occur for a variety of reasons. If a fire occurs aboard your cruise ship, you may have to abandon the ship for a life raft. Typically, fires are caused by someone’s negligent behavior near an open flame. Explosions may also cause a fire, leading to the injury of many passengers. The Bahamas Celebration Cruieline was turned  back in port  after a fire on board forced the cruise liner to return to its home port in Riviera Beach.

Assault
According to reports, assaults aboard cruise ships have become a growing problem. The assault may be physical or sexual in nature, but in either case it is the responsibility of the cruise ship owner to ensure that all passengers are protected from assault. If you’ve been assaulted aboard a cruise ship, report it to the proper authorities immediately and then contact an attorney to learn more about your legal options. Assaults include: sexual assaults, crew on crew, crew on passenger, and are all the responsibility of the cruise company to guard against.
